How long have you lived there?

Nick has lived for 13 years at Barr Bheag in Glen Lonan, Argyll, Scotland, PA35 1HY.

 

What kind of tenants have you been??

We've been good tenants. The rent and bills are always paid on time. We made a lovely flower and vegetable garden. We are respectful of the neighbouring countryside.

What about Nick’s Business, the Rusty Cycle Shed?

Yes, Nick’s business is at Barr Bheag by agreement with our landlord under what, we are arguing, is an associated lease.  The Rusty Cycle Shed is bicycle hire to tourists wanting to explore our beautiful scenery. In addition, the Rusty Cycle Shed does bicycle repairs.

What else is there at Barr Bheag?

We have an established flower and thriving vegetable garden, and some sheds.

 

When did things start to go wrong?

We had a good relationship with the landlord, his family and Factor for many years. It was early in 2015 that we were asked to pay more rent. But before that we asked for repairs to be done to the house.

 

Why did relationships breakdown further?

Around May 2015 a church type 3 foot bell was installed and rung on the hour throughout the day and the night.

 

Did your landlord consult anyone about his plans to have a large bell?

No.

We were really upset that the peace of Glen Lonan had been lost.

 

How did the First Tier Scottish Courts get involved?

The First Tier Scottish Courts became involved to help resolve the disagreements around rights of access and responsibilities for repairs to Barr Bheag.

 

What did the First Tier Scottish Courts do and say about Barr Bheag?

The First Tier Scottish Courts inspected the house and held a tribunal in February 2017.

They said that the house Barr Bheag needed repairs which were the responsibility of the landlord and issued a Repairing Standards Enforcement Order (RSEO).

 

Where are you now?

It's 10 months later and no repairs have been done.

 

Why were you in the Sherriff’s court in Oban on the 7th December, was that to do with the repairs?

No. That wasn’t about the repairs. We were served a writ for repossession of the shed from where the Rusty Cycle Shed operates which, we argue, is held under a lease associated with the house. Also our thriving vegetable garden which, we argue, is part of our assured tenancy.

 

is there any legal action pending?

Yes. The landlord's solicitors have stated in the Sherriff Court that they will be raising proceedings for re-possession of the house at Barr Bheag using demolition as the legal grounds.

Does the house need demolishing?

We don't think so. We think the landlord's primary objective is the eviction.

 

So are you saying that because you objected to your landlord’s church-type bell and wanted repairs on Barr Bheag your home that he is prepared to demolish the house to evict you?

Yes.
