Argyll and Bute submitted statement to DPEA the appeal should be refused on grounds related to sustainable development and that other material considerations should not necessarily be ruled out of the appeal decision process.

A case management discussion was held regaring the landlord's appeal to the Upper Tribunal. Consideration of the appeal will be delayed until after the planning appeal. Counsel for the appellant in this case (Josephine Marshall Trust) admitted that without planning permission being granted that their re-possession action would necessarily fail.

Planning application 18/01786/PP was appealed by the landlord to the Planning and Environmental Appeals Division of the Scottish Government (DPEA) on grounds of non-determination. Ref PPA-130-2070

Tenant and landlord agreed that the Repairing Standard  case and the Re-possession/Demolition case should be conjoined for consideration of the landlord's appeals.

The Repairs Tribunal decided to issue a Notice of Failure to Comply with a Repairing Standard Enforcement Order

The Repairs Tribunal issued a Rent Relief Order to reduce the rent by 85%

 

5th July 2018

The landlord appealed the decision of the Re-possession Tribunal

The Repairs Tribunal issued it's inspection report.

 

9th May 2018

The Repairs Tribunal Surveyor inspected Barr Bheag after the time limit for completion of repairs by the landlord expired. This was to assess whether or not the works required by the tribunal had been completed.

 

19th February 2018

A Case Management Discussion was held in Oban as a preliminary hearing in the case brought by the landlord's for repossession

It was agreed between the landlord and tenants that the case be adjourned until after the Repairs Tribunal had made a decision on the Repairing Standard Enforcement Order.

New deadline for public comment on the planning application for demolition.

The landlord Anthony Robin Marshall's solicitors submit further representations to the Repairs Tribunal in which his solicitor suggests that it would be absurd to require repairs to be carried out.

​

Applicant Anthony Robin Marshall submits futher supporting documentation including the claim that his trust does not have the funds to repair Barr Bheag.

The applicants supporting documentation is removed from the planning portal by the council.

The applicant submits supporting documentation to his own planning application. His principle argument indicates that the demolition is proposed not because it is necessary but because he claims he has a legal right to do so. There is also a lengthy personal attack on the tenants.

The Repairs tribunal Surveyor panel member will inspect the house to see if the repairs have been done. Postponed due to a request for review of a previous decision.

The landlord requested a review of the decision not to vary the Repairing Standard Enforcement Order on an administrative technicality. This will delay the final inspection of the house by the Tribunal Surveyor.

7th December 2017

The Sherriff Court in Oban made the decision to sist the landlord's action to re-possess the shed and vegetable garden at Barr Bheag. This is effectively put on ice until the house re-possession is decided.

Planning application for demolition of Barr Bheag 17/03064/PP is validated awaiting decision.

Repairs Tribunal issues a decision not to extend the time limit for completion of the Repairing Standard Enforcement Order. This stands at 21st December 2017.

 

2nd December 2017 

Planning application for demolition of Barr Bheag 17/03064/PP is removed from planning portal at validation stage.
